Welcome to Design Detail. These Terms of Service ("Terms") govern your access to and use of the Design Detail website, platform, and services (collectively, the "Service") operated by Design Detail ("we", "us", or "our"), a sole proprietorship based in the United Kingdom.

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

Design Detail provides a software-as-a-service (SaaS) platform designed for car detailing businesses. Our Service includes:

  • Embeddable Widgets: Customisable widgets (pricing tables, contact forms, review carousels, before/after sliders) that can be embedded on your existing website
  • Website Builder: A platform to create professional websites for your detailing business
  • Lead Management: Tools to capture and manage customer enquiries
  • Media Library: Storage for images and videos, including Google Drive integration
  • Analytics: Insights into widget and website performance

3. Account Registration

To use our Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorised access to your account
  • Be responsible for all activities that occur under your account

You must be at least 18 years old to create an account and use our Service.

4. Acceptable Use

You agree to use our Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Violate any applicable laws or regulations
  • Infringe on the intellectual property rights of others

  • Your User Content does not infringe on the rights of any third party
  • Your User Content complies with all applicable laws

Our Service integrates with third-party services, including:

  • Google Drive: Optional integration to import images and files
  • Google Maps: For displaying your business reviews
  • Social Media Platforms: For embedding content (TikTok, Instagram)

Your use of third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the content, policies, or practices of third-party services.

7. Intellectual Property

The Service, including its design, features, and content (excluding User Content), is owned by Design Detail and protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Service without our prior written consent.

8. Payment Terms

Some features of our Service may require payment. If you subscribe to a paid plan:

  • You agree to pay all fees associated with your chosen plan
  • Fees are billed in advance on a monthly or annual basis
  • All fees are non-refundable unless otherwise stated
  • We may change our pricing with 30 days' notice
  • Failure to pay may result in suspension or termination of your account

9. Service Availability

We strive to provide a reliable Service, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

  • Scheduled maintenance (we will provide advance notice when possible)
  • Emergency maintenance or repairs
  • Technical issues beyond our control
  • Force majeure events

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will meet your requirements, be uninterrupted, timely, secure, or error-free, or that any defects will be corrected.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DESIGN DETAIL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the Service
  • Any unauthorised access to or use of our servers or your data
  • Any interruption or cessation of the Service
  • Any bugs, viruses, or other harmful code transmitted through the Service
  • Any content or conduct of any third party on the Service

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED POUNDS (£100), WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify, defend, and hold harmless Design Detail and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your User Content, or your violation of these Terms.

13. Termination

You may terminate your account at any time by contacting us at support@designdetail.io or through your account settings.

We may suspend or terminate your access to the Service immediately, without prior notice, if:

  • You breach these Terms
  • You fail to pay applicable fees
  • We are required to do so by law
  • We discontinue the Service

Upon termination, your right to use the Service will cease immediately. We may delete your User Content after a reasonable period following termination.

14. Changes to These Terms

We may modify these Terms at any time. We will notify you of any material changes by email or by posting a notice on our website. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Design Detail regarding the Service and supersede all prior agreements and understandings.
